CASE # <br /> <br /> Public Hearing <br /> CONSIDER ORDINANCE TO VACATE <br /> DRAINAGE AND UTILITY EASEMENT IN PROPOSED <br /> RIVER PINES 6TM ADDITION: CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Breanne Dalnes, Associate Planner <br /> <br />Background: <br /> <br />In conjunction with a minor subdivision, Oakwood Land Development is seeking to vacate an <br />existing 40-foot drainage and utility easement and replace it with a 20-foot easement in order to <br />accommodate one additional lot on the existing property. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Site location map <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of this hearing. <br /> <br />Observations: <br /> <br />City staffhas concerns regarding the vacation of the proposed easement. <br /> <br />Recommendation: <br /> <br />It is recommended that the City Council open the public hearing, close the public hearing, and <br />continue the case until such a time where staff concerns have been resolved. Staff will re-publish <br />the easement vacation at such a time when staff concerns regarding this vacation are resolved. <br /> <br />-179- <br /> <br /> <br />
