CASE # <br />puBLIC HEARING AND REQUEST FOR VACATION OF EASEMENT <br /> IN RAMSEY TOWN CENTER 3ra ADDITION; <br /> CASE OF SOPHIA-RAaMSEY, LLC <br /> By: Sylvia Frolik, Assistant Community Development Director <br /> <br />Background: <br /> <br />As part of fulfilling the City's requirements to provide as-builts upon completion of development <br />projects, the developers of Rarnsey Town Center 3~d Addition determined that the rear wall of the <br />Coboms building encroaches the drainage and utility easement on the south side of the building. <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easement to be vacated <br />Proposed Ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />The amount of encroachment measures 5 feet x 107 feet. The City Engineering Department has <br />reviewed the request and determined that there are no utilities lying under this 5 x 107 foot area. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the ordinance to vacate a portion of the drainage and <br />utility easement along the south property line of Lot 1, Block I, Ramsey Town Center <br />Addition. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #06- to vacate the drainage and utility easements contained on <br />Lot 1, Block 1, Ramsey Town Center Addition 3'd Addition. <br /> <br />Review Checklist: <br /> <br />Public Works Director <br />Engineering Technician IV <br />Community Development Director <br /> <br />CC: 03/28/06 <br /> <br />-181- <br /> <br /> <br />
