There is a public safety concern with permitting longer cul-de-sacs than allowed by City Code. If <br />an emergency would occur it could make ingress and egress more difficult for emergency <br />vehicles. However, the current situation is also not favorable from a public safety standpoint. <br />Currently, there is no public access to Riverbrook, the two lots south of the proposed Shade Tree <br />Creek. Granting the variance would provide better public access to these lots, but would also <br />increase the potential problems associated with development on over-extended cul-de-sacs. <br /> <br />Recommendation: <br /> <br />On March 2, 2006, the Board of Adjustment met and voted 6-0 to deny the variance to maximum <br />cul-de-sac length. The primary reason cited was the increased public safety hazard posed by <br />allowing the development of homes on a street with only one ingress/egress. <br /> <br />In accordance with City Code, Shade Tree Communities filed an appeal to the Board's decision. <br /> <br />City Council Action: <br /> <br />Motion to adopt Resolution #06-03- adopting Findings of Fact # relating to a request <br />from Shade Tree Communities to appeal the Board of Adjustment's decision, <br /> <br />Motion to approve the request for a variance to maximum cul-de-sac length on the Subject <br />Property, based on the findings of fact, and adopt Resolution #05-06- declaring terms of <br />same. <br /> <br />-or- <br /> <br />Motion to adopt Resolution #06-03- <br />the based on the findings of fact. <br /> <br />__ to uphold the Board of Adjustment's decision and deny <br /> <br />Review Checklist: <br />Community Development Director <br />Asst.
