We have <br />at~ended several City meetings a~d work sessions to address both Staff and the Cotmell's <br />concerns related to the cluster development and plat design. <br /> <br />The preliminary plat that the City Council will be'reviewing at their March 28, 2006 <br />meeting is a direct result of working with City Staff and the City Council. City Staff <br />directed us to extend Erkium Street to the edge of the southern botmdary line in order to <br />provide a connection to an existing public street (within the MeIoche property). This <br />direction resulted in the need to apply for a variance to cul-de-sac length. We applied for <br />the variance in order to continue to work with the City to assist in achieving overall street <br />connection goals. <br /> <br />We are now in a situation where the Board of Adjustment has denied our variance <br />application. We took a closer look at Shade Tree Creek to determine our options. The plat <br />could be revised to accommodate 16 single-family lots and still meet the City's 600 feet <br />cul-de-sac length requirement Subsequent to the Board of the Adjustment toeing, we <br />meet with City Staff to obtain their opinion and receive further direction regarding this <br />matter. The meeting resulted iu Shade Tree applying for au appeal to the Board of <br />Adjustment's denial decision. The reasons that facilitated the appeal are: 1. City Code <br />requires streets to be connected 2. Staff stated that whether it is now or in the future they <br />would like to see Erkium Street located within the Meloche property connected to <br />Erkium Street located north of 177m. 3. The existing Class 5 / private access easement <br />situation would be improved due to the platting of a public street and street improvements <br />made within Shade Tree Creek.
