Vice Chair Johnson asked if when the City has gone into existing 2 V2 acre developments <br />with sewer and water they have had to reconfigure extensively to bring in services. <br /> <br />City Engineer Jankowski stated there would be disturbance to the streets, but not the lots. <br /> <br />Ken Thomas asked if the developer would be raising the land because he does not want <br />run offcoming to the homes on Cobalt. He stated when they start this development it has <br />to be done right. He asked what would happen to the run off if they raised the lots. <br /> <br />Dave Ness, 17800 Florine Street, asked if it is law that cluster ordinances have to be <br />allowed, or if it could be repealed or changed as far as the size of the lots. <br /> <br />Vice Chairperson Johnson indicated it is currently an ordinance of the City. He stated <br />that in a sense it cannot be appealed because it is in place. He indicated it is usually <br />possible to consider variances from the ordinance, but a fundamental part of that is that <br />the person who has the authority to ask for a variance is the developer. <br /> <br />Mr. Ness asked why they would consider putting homes so close. <br /> <br />Vice Chairperson Johnson stated that City ordinance says you have to build in a cluster <br />format. <br /> <br />Mr. Ness stated he has lived in Ramsey for sixteen years and has never heard about <br />clusters before. <br /> <br />Anita Adriaens, 17680 Argon St, stated that she would ask the Planning Commission to <br />deny this request for two reasons. She indicated that the Fire Chief said there are safety <br />issues, and there are still questions with the well engineering. <br /> <br />Cheri Frame, 8901 167th Lane, stated there are two issues that impact her development <br />also. She indicated the reason she found out that she was not notified of the cluster <br />ordinance was because only owners with more than five acres were noticed. She stated <br />she should have been on guard, but was not and now this ordinance is on the books. She <br />indicated there could be smaller transition lots, but it does not have to be the smallest lots <br />possible. <br /> <br />Vice Chairperson Johnson asked if the cluster ordinance public heatings were generally <br />noticed as well, and Community Development Director Trudgeon replied that they were. <br /> <br />Vice Chairperson Johnson indicated that as they know from other matters, a general <br />notice in the business section is not an effective notice. <br /> <br />John Karst, 17650 Cobalt asked when the cluster ordinance went into affect. <br /> <br />Associate Planner Dalnes stated that the public hearing was held in August of 2004, and <br />finally adopted April of 2005. <br /> <br />-291- <br /> <br /> <br />
