introduced the following resolution and moved for its adoption: RESOLUTION//06-03- RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL TO SHADE TREE CREEK WHEREAS, Shade Tree Communities, hereinafter referred to as "Developer", has properly applied for preliminary plat approval on the following described property located in the City of Ramsey: The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota. Subject to an easement for road purposes over the west 66.00 feet of the east 250.81 feet thereof. (the "Subject Property") WHEREAS, on May 5, 2005 the Planning Commission reviewed the sketch plan for Shade Tree 'Communities, expressed concern with the lack of density transitioning and the location of the lots, and provided feedback to the developer; and WHEREAS, on December 30, 2005, the City of Ramsey received an application for a preliminary plat for subdivision from Shade Tree Communities; and WHEREAS, on February 2, 2006, the Planning Commission reviewed and tabled action on the proposed preliminary plat in order to receive additional information regarding the soils on the site and the location and design of the community septic system and; WHEREAS, on March 3, 2006, the Planning Commission reviewed the application materials, and recommended denial of the preliminary plat for the following reasons: the increased public safety hazard of allowing a development with a single access, an over-extended cul-de-sac, and the lack of adequate density transitioning. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: I) 2) That the Ramsey City Council hereby grants preliminary plat approval to Shade Tree Creek, contingent upon compliance with City Staff review letter dated January 27, 2006, revised February 28, 2006, and March 24, 2006. That the Developer is herein advised to proceed to the final plat stage. -305-
