CASE # <br /> <br />APPROVE FIELD USE AGREEMENT AND 2006 FIELD MAINTENANCE FEES <br /> <br />By: Mark Riverblood, Parks & Utilities Supervisor <br /> <br />Background: <br /> <br />The purpose of this case is to approve the field use agreement for PACT Charter School; and <br />2006 athletic field maintenance fees for both the youth athletic group(s), and the school. These <br />two subjects are discussed separately below. <br /> <br />Observations: <br /> <br />PACT SCHOOL AGREEMENT <br />As Council is aware, the PACT Charter School has requested that they receive some assurances <br />that they may use the park space adjacent to their building (presently referred to as 'South Park') <br />as part of their daytime programming. This use was predicated on having a suitable agreement <br />that protected the City's interests, while insuring that PACT can count on programming the <br />space during school days with limited conflicts. Staff believes that the attached Field Use <br />Agreement achieves these goals. The following is a bullet point summary of the key elements of <br />this draft agreement: <br /> <br />· The Agreement has the appropriate indemnification and insurances clauses and requires <br /> criminal background checks for those overseeing youth activities on City property. <br />· The School shall have primary (not exclusive) use of the premises on school days until <br /> 5:30 or 6:00 p.m., and the City shall maintain full use of the park outside of this period <br /> unless agreed to otherwise. <br />· The City may preempt the School's scheduled use if needed (as in the case of parking for <br /> an event as an example). <br />· Either party may cancel the agreement upon a 90-day notice, or the City may cancel with <br /> a 30-day notice ifa default by the school occurs. <br />· The agreement may be amended each year by the City and adjusted accordingly - based <br /> upon costs and actual experience. <br />· The City shall perform all maintenance except; the School shall perform all litter control <br /> and removal on school days. <br /> <br />In consideration for this agreement, PACT Charter School will pay a base-rate fee of $500 per <br />year, and a field maintenance fee consistent with those fees charged other youth athletic <br />associations in Ramsey. <br /> <br />-339- <br /> <br /> <br />
