CounciLmember Cox introduced the following resolution and moved for its <br />adoption: ~ <br /> RESOLUTION #81- <br /> <br /> WHEREAS, Charles H. Olson and Connie Olson are the owners of <br />the following described property: <br /> The Southeast Quarter of the Northeast Quarter and the <br /> West 66 feet of the East 528 feet of the Northeast <br /> Quarter of the Northeast Quarter all in Section 4, <br /> Township 32, Range 25. <br /> <br />and <br /> WBEREAS~ John Brolsma and Lorraine Brolsma desire to purchase <br />the above described parcel and construct a home~ and <br /> WHEREAS~ the parcel does not have 200 foot frontage on a <br />public road as required by City Code, but rather it has only 66 foot <br />of public road frontage; and <br /> WHEREAS~ the 66 foot tract above described was subdivided con- <br /> trary to the City Code and State Law~ and <br /> WHEREAS~ the City Council finds that the 40 acre tract is <br /> landlocked except for its 66 foot wide access and it is almost impossible <br /> to get a 200 foot of public road frontage for this 40'acre tract because <br /> of previous development adjacent to it; and <br /> WHEREAS, the landowner snd proposed purchaser have applied to <br /> the City for a varisnce from the City Code such as to allow a building <br /> on less than 200 foot frontage and a variance to the City's subdivision <br /> code such as to allow the 66 foot tract to be created by metes and <br /> bounds; and <br /> WHEREAS, the City Council finds that to deny the building per- <br /> mit and variances would create an unnecessary hardship on the parties <br /> involved, name of whom created the circumstance. <br /> NOW THEREFOP~E, IT IS HEREBY RESOLVED, as follows: <br /> l) That a variance is hereby granted such that the 40 acre <br /> parcel above described may receive one residential building permit, not <br /> withstanding that it does not have 200 feet of public road frontage. <br /> 2) That the West 66 feet of the East 528 feet of the North- <br /> east Quarter of the Northeast Quarter of Section 4, Township 32, Range <br /> 25, may be subdivided by a metes and bounds description and made a part <br /> of the above described 40 acre parcel such that the 66 foot wide parcel <br /> and the 40 acre parcel become one parcel for legal description and tax <br /> record purposes. <br /> <br /> <br />
