pE RFOPJ~ANCE CONTRACT <br />WITH <br /> <br /> TEE CITY OF RAMSEY <br /> <br /> THIS AGRE~4ENT, made and entered into the _ day of <br /> <br /> , 1981, by and between the City of Ramsey, <br />located in Anoka County, State of Minnesota, hereinafter <br />referred to as the "city", and N.D.H., Inc., a Minnesota <br />corporation, having its principal place of business at 700 <br />Industry Avenue N.W., Anoka, Minnesota 55303, hereinafter <br />referred to as the "Developer". <br /> <br /> WHEREAS, the Developer has applied to the City Council <br />for a plat approval of the proposed plat known as Flintwood <br />Hills Second Addition; and <br /> %~EREAS, the City Council has given approval of said <br />preliminary plat; and <br /> <br /> WHEREAS, the Developer is.required as a condition of <br />the City's approval of said plat to enter into a contract <br />binding it to perform certain acts and duties within a <br />specified time; and <br /> <br /> WHEREAS, the City Council requires that said conditions <br />be performed in a timely manner and a bond for the performance <br />of said conditions must be filed assuring the City of full <br />performance within the certain specified period of time; and <br /> %~EREAS, the Developer has agreed to perform said aots <br /> and duties in a timely manner; and <br /> <br /> ¥~EP~EAS, the city Council has agreed to and does grant <br /> its approval to the Developer's plat known as Flintwood <br /> Hills Second Addition subject to the Developer's agreement <br /> to perform said acts and duties as are hereinafter set <br /> forth. <br /> <br /> NOW, THEREFORE, IT IS HEREBY COVENANTED AND AGREED, <br /> tha~ the City Council has granted its approval to Flintwood <br /> Hills Second Addition plat, and the Developer has agreed to <br /> the following: <br /> <br /> <br />
