City shall be entitled to recover the amount held by the

<br />city in escrow pursuant to paragraph 4 above.
<br />
<br /> 7. That in the event either performance bond is forfeited
<br />and the escrow fund is forfeited and the City constructs or
<br />completes all of the required acts as set forth aforesaid
<br />and the City finds that the cost of such improvements exceeds
<br />the amount of the forfeited bond, the remaining balance of
<br />said costs can and shall be assessed against all of the
<br />property in the said plat.
<br />
<br /> 8. The Developer agrees that no building permit shall
<br />be issued for any of the following described lots until such
<br />time as the City of Ramsey shall have completed a sanitary
<br />sewer project to service said lots, to-wit=
<br />
<br /> Lots 3, 4, 5, 7, 9, 11 and 13, Block 1;
<br /> Lots 1, 2, 3, 5, 7, 9, 11 and 13, Block 2; '
<br /> Lots 1, 2, 3, 4, 5, 7, 8, lO, 12, 14, 16, 17,
<br /> 19, 21, 22, 24, 25, 26 and 27, Block 4;
<br /> Lots 1, 3, 5, 7, 9 and 11, Block 5;
<br /> Lots 2, 3, 5 and 6, Block .~;
<br /> Lots 1 through 11, inclusive, Block 7;
<br /> Ail in Flintwood Hills Second Addition.
<br />
<br /> 9. The Developer agrees that the owners of the remaining
<br />lots which are not included in paragraph 8 above in Flintwood
<br />Hills Second Addition upon which buildings have been erected
<br />shall connect to a publio sanitary sewer system within one
<br />year of the date on which the City of Ramsey has completed
<br />such sanitary sewer project to service said lots.
<br />
<br /> 10. The Developer agrees that all of the individual
<br />lots in Flintwood Hills Second Addition shall be subject to
<br />special assessments to be levie~ by the City of Ramsey,
<br />pursuant to statute, for the installation of said sanitary
<br />sewer project, if such project is installed, and the liability
<br />for payment of such assessments, if any, shall be borne by the
<br />then individual lot owners.
<br />
<br /> ll. The Developer, for itself, its successors and
<br />assigns, hereby covenants and agrees not to contest the
<br />determination by the City of Ramsey, if any, that the
<br />installation of said sanitary sewer system to service the
<br />lots contained in the plat herein is necessary, in the public
<br />interest, and of benefit to said lots.
