PROPOSED FINDINGS OF FACT l) That the applicant has properly applied for a Board of Adjustment variance, as required by City ordinance, to place a garage nearer the front property line than required. 2) That the applicant appeared before the Beard of Adjustment for a public hearing pursuant to City ordinance on ~ay 12, 1981. That said public hearing was properly advertised and the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3) That the applicant has submitted a site plan for the requested variance, said site plaI1 is hereinafter referred to as Exhibit "A" and is hereby incorporated as a part of these findings. 4~ That there are no exceptional, unique or extraordinary circumstances or conditions applying to the property in question that do not apply generally to other properties in s83ne zoning district. 5) That such a variance is not necessary for the preservation and en- joyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the same vicinity. 6) That the authorizing of said variance will not be a detriment to a~acent properties and will not mterially impair the intent and purpose of this ordinance or the public interest. 7) That the intended use of said property for which said variance is requested is not so general or recurrent a nature as to make reasonably practicable the formulation a general regulation for such conditions or situations. 8). That the variance observes the spirit and intent of the cities ordi- nance, produces substantial justice and is not contrary to the public interest.
