PROPOSED FINDINGS OF FACT <br /> <br />l) That the applicant has properly applied for a Board of Adjustment <br />variance, as required by City ordinance, to place a garage nearer the <br />front property line than required. <br />2) That the applicant appeared before the Beard of Adjustment for a <br />public hearing pursuant to City ordinance on ~ay 12, 1981. That said <br />public hearing was properly advertised and the minutes of said public <br />hearing are hereby incorporated as a part of these findings by <br />reference. <br /> 3) That the applicant has submitted a site plan for the requested <br /> variance, said site plaI1 is hereinafter referred to as Exhibit "A" <br /> and is hereby incorporated as a part of these findings. <br /> 4~ That there are no exceptional, unique or extraordinary circumstances <br /> or conditions applying to the property in question that do not apply <br /> generally to other properties in s83ne zoning district. <br /> 5) That such a variance is not necessary for the preservation and en- <br /> joyment of a substantial property right similar to that possessed by <br /> other properties in the same zoning district and in the same vicinity. <br /> 6) That the authorizing of said variance will not be a detriment to <br /> a~acent properties and will not mterially impair the intent and <br /> purpose of this ordinance or the public interest. <br /> 7) That the intended use of said property for which said variance is <br /> requested is not so general or recurrent a nature as to make reasonably <br /> practicable the formulation a general regulation for such conditions <br /> or situations. <br /> 8). That the variance observes the spirit and intent of the cities ordi- <br /> nance, produces substantial justice and is not contrary to the public <br /> interest. <br /> <br /> <br />
