S. ~IG~AY $10 UTILITIES EIX~S~N~.R sIGN COMPANY By: Bill Goodrich, City Attorney Background: As you know, the City is in the prOCeSS of acquiring fee title to an 80 foot wide street right-of-way for the extension of Sunfish Lake Boulevard N.W. south of U. S. Hig~hway ~10 from ~r. and Mrs. Ralph Elofson. of their ~o~rtv to l~ele ~Cign Co~:panl' ~_c ..... The si~n is in the middle cf the 80 foot right-of- way we are acq. uiring and needs to be r~noved. If the si~n is removed, Nagele Sign Company is claiming that it will lose advertising income for the next three years at the rate of $500 per month. Nagele Sign Company is willing to have the sign moved to a new location under certain conditions as follows: 1) Extend lease term for three additional years; 2) Sign to become two-sided (it is now a one-sided sign). City Engineer F~atikka states that the sign could be m~,ed to the far easterly right-of-way of Sunfish Lake Boulevard N.W. The Elofsons state tLmt they can get Nagele Sign Company to move the sign at no cost to the City, but in return the Elofsons want the annual rent. The Elofsons do not want the sign placed on their property. The City's sign regulations state that a sign cannot be placed on public right-of-way. I believe the Council's options are as follows: 1) Commence condemnation against Nagele Sign Company and pay whatever damages are assessed; 2) Negotiate with Nagele Sign Company to move the sign at City expense, as it is to the far easterly right-of-way boundary of Sunfish Lake Boulevard N.W. and then the City would keep the annual rent for the moving expense and the lease would expire in three years; 3) Negotiate with Nagele Sign Company to allow the sign to become two- sided and placed on the City's easterly right-of-way, extend the lease for three years and give the rent to the Elofsons; ~) Sa/ne as o.~ticn 3 above, but place the sign at the City's westerly righn-cf-~;ay. Finally, any placa~est of sign on the City right-of-way will re<~ulre a variance to sign regulations which ma5' be a precedent you are unwilling to establish.
