S. ~IG~AY $10 UTILITIES <br /> EIX~S~N~.R sIGN COMPANY <br /> By: Bill Goodrich, City Attorney <br /> <br />Background: <br />As you know, the City is in the prOCeSS of acquiring fee title to an 80 foot <br />wide street right-of-way for the extension of Sunfish Lake Boulevard N.W. south <br />of U. S. Hig~hway ~10 from ~r. and Mrs. Ralph Elofson. <br /> of their ~o~rtv to l~ele ~Cign Co~:panl' <br /> ~_c ..... This is a ten year lease, <br /> In ._el th~ r~' ~c~ leased a portion <br /> for the erecnion of ~-~, outdoor advertising sion. - <br /> e~iring on ~.~sy 15, 1991. The si~n is in the middle cf the 80 foot right-of- <br /> way we are acq. uiring and needs to be r~noved. If the si~n is removed, Nagele <br /> Sign Company is claiming that it will lose advertising income for the next <br /> three years at the rate of $500 per month. Nagele Sign Company is willing to <br /> have the sign moved to a new location under certain conditions as follows: <br /> 1) Extend lease term for three additional years; <br /> <br /> 2) Sign to become two-sided (it is now a one-sided sign). <br /> City Engineer F~atikka states that the sign could be m~,ed to the far easterly <br /> right-of-way of Sunfish Lake Boulevard N.W. <br /> The Elofsons state tLmt they can get Nagele Sign Company to move the sign at no <br /> cost to the City, but in return the Elofsons want the annual rent. The <br /> Elofsons do not want the sign placed on their property. The City's sign <br /> regulations state that a sign cannot be placed on public right-of-way. <br /> I believe the Council's options are as follows: <br /> <br /> 1) Commence condemnation against Nagele Sign Company and pay whatever <br /> damages are assessed; <br /> <br /> 2) Negotiate with Nagele Sign Company to move the sign at City expense, <br /> as it is to the far easterly right-of-way boundary of Sunfish Lake <br /> Boulevard N.W. and then the City would keep the annual rent for the <br /> moving expense and the lease would expire in three years; <br /> <br /> 3) Negotiate with Nagele Sign Company to allow the sign to become two- <br /> sided and placed on the City's easterly right-of-way, extend the lease <br /> for three years and give the rent to the Elofsons; <br /> <br /> ~) Sa/ne as o.~ticn 3 above, but place the sign at the City's westerly <br /> righn-cf-~;ay. <br /> Finally, any placa~est of sign on the City right-of-way will re<~ulre a variance <br /> to sign regulations which ma5' be a precedent you are unwilling to establish. <br /> <br />Recommendation: <br />Council a~ion will be to direct City St-off based on discussion of the above <br />information. <br /> <br />R~view Checklist: <br /> <br />Administrator X.. <br />Attorney X. <br />Lngineer X <br />Co.~unityDevelopment Director X. <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
