cITY OF RA~SEY <br /> <br /> PROPOSED FINDINGS OF FACT <br /> <br />RE: JOSEPH SENTRYZ CONDITIONAL uSE PERMIT <br /> <br />1) That the Applicant has properly applied for a conditional use permit, <br />as required by ordinance to operate and maintain a day care center. <br />2) That the Applicant appeared before the Planning and Zoning Commission <br />for a public hesring pursuant to the City Zoning Ordinance on June 2, <br />1981. That said public hearing was properly advertized and the minutes <br />of that public hearing are hereby incorporated by reference. <br /> J <br /> <br />3) ~hat the standards for consideration are as follows: <br /> a) The property is zoned B-1 commercial and this is not <br /> a permitted use, <br /> b) The adjoining properties are either vacant or are <br /> business operations located on lots one plus acres in <br /> size. <br /> c) There are no similar uses known to exist in the area. <br /> d) The additional traffic flows will not adversely affect <br /> traffic flows in the area inasmuch as the new source ~of <br /> traffic will be at times other than the heavier traffic <br /> flows that now exist. <br /> e) There are, in all likelihood, numeroUS similar uses <br /> that are currently in operation in the City in residential <br /> dwellings. However, these have not, to date, been required <br /> to have conditional use permits. Therefore, the exact <br /> number of existing similar uses is not known. <br /> ~f) Properly maintained, the day care facility will not <br /> affect the business operations of adjoining businesses. <br /> Further, it ~ill not affect the value of properties in <br /> the area. <br />' -4~ What the criteria for Approval/Disapproval are as follows: <br /> a) That the establishment, maintenance and operation of <br /> a day care facility will not be detrimental to or endanger <br /> <br /> <br />
