sewer and water. He stated there is at least a conceptual plan for the surrounding area from this <br />parcel. He added that the City has a master sewer plan that shows the general trunk areas, but he <br />does not know exactly how it will come up to that area. He stated that generally a water main <br />can follow the existing right-of-way. <br /> <br />Vice Chair Johnson asked if when the City has gone into existing 2 ½ acre developments with <br />sewer and water they have had to reconfigure extensively to bring in services. <br /> <br />City Engineer Jankowski stated there would be disturbance to the streets, but not the lots. <br /> <br />Ken Thomas asked if the developer would be raising the land because he does not want nm off <br />coming to the homes on Cobalt. He stated when they start this development it has to be done <br />right. He asked what would happen to the run off if they raised the lots. <br /> <br />Dave Ness, 17800 Florine Street, asked if it is law that cluster ordinances have to be allowed, or <br />if it could be repealed or changed as far as the size of the lots. <br /> <br />Vice Chairperson Johnson indicated it is currently an ordinance of the City. He stated that in a <br />sense it cannot be appealed because it is in place. He indicated it is usually possible to consider <br />variances from the ordinance, but a fundamental part of that is that the person who has the <br />authority to ask for a variance is the developer. <br /> <br />Mr. Ness asked why they would consider putting homes so close. <br /> <br />Vice Chairperson Johnson stated that City ordinance says you have to build in a cluster format. <br /> <br />Mr. Ness stated he has lived in Ramsey for sixteen years and has never heard about clusters <br />before. <br /> <br />Anita Adriaens, 17680 Argon St, stated that she would ask the Planning Commission to deny this <br />request for two reasons. She indicated that the Fire Chief said there are safety issues, and there <br />are still questions with the well engineering. <br /> <br />Cheil Frame, 8901 167th Lane, stated there are two issues that impact her development also. She <br />indicated the mason she found out that she was not notified of the cluster ordinance was because <br />only owners with more ~:han five acres were noticed. She stated she should have been on guard, <br />but was not and now this ordinance is on the books. She indicated there could be smaller <br />transition lots, but it does not have to be the smallest lots possible. <br /> <br />Vice Chairperson Johnson asked if the cluster ordinance public hearings were generally noticed <br />as well, and Community Development Director Trudgeon replied that they were. <br /> <br />Vice Chairperson Johnson indicated that as they know from other matters, a general notice in the <br />business section is not an effective notice. <br /> <br /> Planning Commission/March 2, 2006 <br /> Page 10 of 31 <br />PlO <br /> <br /> <br />
