CITY COUNCIL WORK SESSION <br /> <br />Topic Report: <br />Neighborhood <br /> <br />Development Notification To Adjacent <br /> <br />By: Sylvia Frolik/Assistant Community Development Director <br /> <br />Background: <br /> <br />At the City Council meeting on March 14, 2006, the City Council directed City Staffto prepare a <br />Topic Report for an upcoming Work Session regarding public notification procedures. <br /> <br />Summary of State Statute Requirements: <br /> <br /> Subdivsions: State statute does not require sketch plans for subdivisions. State statute does <br />require a public hearing at the preliminary plat stage. The preliminary plat public hearing must be <br />advertised in the official City newspaper, but individual mailed notice to adjacent neighborhoods is <br />not required. State statute does not requ/re public hearings or mailed notices regarding final plat <br />applications. <br /> <br /> Zoning Amendments: State statute does require a public hearing that is advertised in the <br />official City newspaper regarding proposed amendments to the zoning regulations or map. <br />Individual mailed notice is only required, to owners of property within 350 feet of the subject <br />property, when the proposed zoning amendment changes the district boundary on parcels less than <br />5 acres in size. <br /> <br /> Conditional and Interim Use Permits: Statutes require same procedure as for Zoning <br />Amendments. <br /> <br /> Easement Vacations: State Statutes don't require a public hearing; only that affected <br />property owners are notified. <br /> <br />Summary of City Requirements <br /> <br /> Subdivisions: City Code requires that owners of property within 700 feet of a proposed <br />subdivision be provided individual mailed notice of the sketch plan application. City Code requires <br />a public hearing for the preliminary plat and also requires individual mailed notices to property <br />owners within 700 feet of the subject property. City Code does not require public hearing or <br />individual mailed notices of final plat applications. <br /> <br /> <br />
