CC Regular Session <br />Meeting Date: 05/09/2023 <br />Submitted For: Stephanie Hanson, Community Development <br />By: Stephanie Hanson, Community Development <br />Information <br />Title: <br />Introduce Ordinance #23-09 Interim Use Ordinance Prohibiting the Sales of Adult -Use Cannabis <br />Purpose/Background: <br />6.1. <br />At the April 11, 2023 City Council Work Sessions, the Council gave staff direction to proceed to draft an Interim <br />Ordinance to prohibit the sale of THC products until ordinances for restrictions on the operation of businesses are <br />developed, forms and procedures are put in place and policies and procedures for performance compliance checks <br />are in place. <br />As part of the 2023 Minnesota Legislative session, HF 100 Regulation of Adult -Use Cannabis continues and has <br />passed the house and senate. As of July 1, 2023, it will be legal to possess a regulated amount of THC products. <br />As of January 1, 2024, it will be legal for the commercial sales of THC with approved licenses from the State of <br />MN and the City of Ramsey. <br />As part of the current proposed language in the bill, Section 13. [342.13] LOCAL CONTROL, gives local <br />governments the authority to adopt an interim ordinance (moratorium) that "may regulate, restrict, or prohibit the <br />operation of a cannabis business within the jurisdiction or portion thereof until January 1, 2025." During the time <br />of the interim ordinance, staff would be working closely with the Office of Cannabis Management (the Office) to <br />develop ordinances for reasonable restrictions of the operation of a cannabis or hemp business, develop <br />standardized forms and procedures for the issuance of retail registration, and develop policies and procedures for <br />the performance compliance checks. <br />Draft Ordinance #23-09 is attached for your review. City Attorney Fritz Knaak assisted with the writing of the <br />draft and has approved the attached draft. <br />Notification: <br />A public hearing notice was published in the newspaper, advertised on the city website and posted in City hall. <br />Time Frame/Observations/Alternatives: <br />If the interim ordinance is adopted, it will remain in effect for one (1) year or until City Council determines the <br />proper regulations are in place for the sale of adult -use cannabis. <br />Recommendation: <br />Staff suggests City Council hold a public hearing for the first reading to introduce Ordinance #23-09, An Interim <br />Ordinance Prohibiting the Sales of Adult -Use Cannabis <br />Outcome/Action: <br />Hold a public hearing for the introduction of Ordinance #23-09, An Interim Ordinance Prohibiting the Sales <br />of Adult -Use Cannabis <br />
