CASE <br /> <br />ADOPTION OF RURAL DEVELOPING INTERIM ORDINANCE; <br />CASE OF CITY OF RAMSEY <br /> By: Patrick Trudgeon, AICP, Community Development Director <br /> <br />Background: <br /> <br />On April 4, 2005, Ordinance #05-03 became effective requiring the clustering of residential <br />subdivisions in the area designated R-1 Rural Developing Zoning District. Since that time, the <br />City has been considering four residential cluster subdivisions. From this review, the City <br />Council has noted several deficiencies in the current ordinance and a desire to review the whole <br />ordinance to ensure their concerns are addressed. <br /> <br />At the March 28, 2006 meeting, the City Council introduced a proposed interim ordinance that <br />would place a one-year moratorium on platting and subdividing land in the R-1 Rural <br />Developing Zoning District. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Moratorium map exhibit <br />b) Proposed interim ordinance <br /> <br />Notification: <br /> <br />A public hearing is not required to adopt an interim ordinance. <br /> <br />Observations: <br /> <br />As written, the proposed interim ordinance would prohibit all platting and subdividing in the R-I <br />Rural Developing Zoning District. The ordinance does allow for exceptions, based on hardship. <br />It should be noted that the City will continue to issue building permits for existing lots while the <br />moratorium is in effect: <br /> <br />In order to address the possibility of a parcel within the R-1 Rural Developing Zoning District <br />having it's land use changed to allow for City sewer and water to serve the pamel, Staff has <br />added language that would allow for the subdivision of parcels that receive a land use change <br />through an approved Comprehensive Plan amendment approved by the City Council and <br />Metropolitan Council. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the interim ordinance. <br /> <br />-187- <br /> <br /> <br />
