CASE <br /> <br /> ADOPTION OF ORDINANCE TO VACATE <br />DRAINAGE AND UTILITY EASEMENT IN HIGHLANDS AT RIVER PARK <br />4TM ADDITIONi CASE OF JASON PETERSON <br /> By: Breanne Dairies, Associate Planner <br /> <br />Background: <br /> <br />Jason Peterson of Maple Leaf Custom Homes, is requesting an administrative subdivision to <br />realign a common property line between two lots that he owns. In order to process the <br />administrative subdivision, it is necessary to vacate the easements along the common property <br />line. The proposed ordinance vacates all easements and reestablishes new easements in the <br />appropriate locations. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />City Council Minutes dated February 28, 2006 <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were <br />notified of the introduction of this ordinance. A public hearing was held at the February 28, <br />2006 City Council meeting. <br /> <br />ObserVations: <br /> <br />The applicant is seeking to realign the common, property line along Lot 9 and Lot 10 of Block 1, <br />Highlands at River Park 4th Addition. The purpose of this administrative subdivision is to <br />increase the area of Lot 10 to accommodate an in-ground pool in the backyard. Maple Leaf <br />Custom Homes currently owns both lots, and seeks to make the adjustment. The proposed <br />change will add approximately 2,380 square feet to Lot I0. Both lots will remain in conformance <br />to City Code. Maple Leaf will be required to provide the City with a replacement easement along <br />the new common property line. <br /> <br />The existing easements on the common property line of Lots 9 and 10, Block 1, will be vacated <br />and a new easement will be taken on the new property line. <br /> <br />The public hearing to vacate easements was held at the City Council meeting on February 28, <br />2006. One resident spoke and wanted to make sure that any house built on Lots 9 and 10 would <br />be able to fit on the reconfigured lots. Staff explained that new parcels created from the <br />administrative subdivision will be able to meet the required setbacks. <br /> <br />Recommendation:. <br /> <br />City Staffrecommends adoption of the enclosed ordinarice to vacate the existing easements. <br /> <br />-203- <br /> <br /> <br />
