Megan Wald, representing ShadeTree Construction, stated that in regard to the cul-de-sac length, <br />regardless of how this property developed they would need a variance because of the two homes <br />on the back of the property to which the City has already issued a permit. She indicated that she <br />is very excited that the City is looking to provide a second access, which they would prefer. <br /> <br />Ms. Wald advised that the homes would be in the $300,000 to $360,000 range. She stated that <br />ShadeTree does not regulate rental homes, but the City has regulations for rentals. She indicated <br />that they do meet all the City requirements for a cluster ordinance, noting that they actually had <br />to reduce one lot size because there is a maximmn lot size allowed under the cluster ordinance. <br /> <br />Vice Chairperson Johnson asked if this property was purchased after the cluster ordinance went <br />into effect. <br /> <br />Ms. Wald stated that it was purchased knowing it fell under the cluster ordinance, after that <br />ordinance had passed. <br /> <br />Commissioner Van Scoy asked about access to the septic system from the road. <br /> <br />Ms. Wald stated that 177th will access the area. She indicated that there will be a Class V <br />driveway to the system itself. <br /> <br />Commissioner Van Scoy asked if there is a sidewalk in the development, to which Ms. Wald <br />replied that there is not. Commissioner Van Scoy asked ifa sidewalk was required. <br /> <br />Community Development Director Trudgeon indicated that cul-de-sacs are not required to have <br />sidewalks. <br /> <br />Commissioner Brauer stated that is something they will want to keep in mind with future cluster <br />developments. <br /> <br />Diane Karst, 17650 Cobalt, indicated that if water comes down off that property it will be in her <br />backyard. She stated that she keeps hearing about the DNR, but asked who was responsible for <br />contacting the DNR about the wetland, and who sets those standards. <br /> <br />City Engineer Jankowski stated that if the question is about wetlands, all of the wetlands in <br />Minnesota are protected by a number of organizations. He indicated that the larger ones are <br />protected by the DNR,and the smaller ones are protected by the Wetland Conservation Act, <br />which is administered by the Watershed District. He stated that they need a wetland delineation, <br />which will be reviewed. He indicated that the delineation has been done, and the proposed <br />development plan avoids those wetland areas. <br /> <br />Jeff Sigler, 17571 Baugh Street, indicated he is curious about the lot prices. <br /> <br />Ms. Wald stated that they do not determine prices based just on the lot or the house; they do <br />package prices. <br /> <br />Planning Commission/March 2, 2006 <br /> Page 12 of 31 <br /> <br /> <br />
