Board Member Johnson introduced the following resolution and moved for its adoption: RESOLUTION//06-03-075 A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE TO CUL-DE-SAC LENGTH IN THE PROPOSED PLAT OF SHADE TREE CREEK AND DECLARING TERMS OF THE SAME. WHEREAS, Shade Tree Construction (Permittee) has properly applied for a variance from the maximum cul-de-sac length prescribed in Section 9.50.30, Subd. 4(g) on the property generally located south 177th Avenue and Erkium Street, legally described as, The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota. Subject to an easement for road purposes over the west 66.00 feet of the east 250.81 feet thereofi WHEREAS, the Board of Adjustment met on February 2, 2006, conducted the public hearing and tabled the application relating to the request for a variance from the maximum cul- de-sac length requirements on the Subject Property and, WHEREAS, the Board of Adjustment met on March 3, 2006, continued the public hearing and denied the application relating to the request for a variance from the maximum cul- de-sac length requirements on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #0755, a variance to the 600-foot cul-de-sac length, as established in Section 9.50.30, Subd. 4(g) of the Ramsey City Code, is hereby denied for the Subject Property for Erkium Street.
