Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-06-180 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHEREAS, RAMSEY TOWN CENTER, LLC, AND K. HOVNANIAN T&C HOMES <br />AT MINNESOTA, L.L.C., hereinafter referred to as "Applicants," have properly applied for a <br />variance from Section 9.20.25(3)(b) regarding maximum front yard setbacks in the TC-4b Sub- <br />District of the Town Center District, on the property legally described as follows: <br /> <br />Outlot U, Ramsey Town Center Addition, according to the recorded plat thereof, <br />Anoka County, Minnesota <br /> <br />And that K. Hovnanian T&C Homes at Minnesota, L.L.C., a Minnesota limited <br />liability company, fee owner of the following described property: <br /> <br />All that part of Outlot B, Ramsey Town Center 2nd Addition, according to the <br />recorded plat thereof, described as follows: <br /> <br />Beginning at the northwest comer of said Outlot B; thence on an assumed bearing of <br />south 89 degrees 42 minutes 54 seconds east along the northerly line of said Outlot <br />B, for 607.10 feet; thence on a bearing of south for 247.47 feet to a southerly line of <br />said Outlot B; thence on a bearing of west along said southerly line and its westerly <br />extension for 616.21 feet to the westerly line of said Outlot B; thence north 07 <br />degrees 21 minutes 03 seconds east, along said westerly line for 4.51 feet to a point <br />of curvature in said westerly line; thence northerly for 133.32 feet, along said <br />westerly line, along a tangential curve concave to the west, radius 1040.00 feet and <br />central angle 07 degrees 21 minutes 03 seconds, to a point of tangency in said <br />westerly line; thence on a beating of north, along said westerly line for 112.96 feet to <br />the point of beginning. <br /> <br />(the "Subject Property") <br /> <br /> WHEREAS, the Board of Adjustment met on June 23, 2005, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from the maximum <br />front yard setback requirements as part of the development of the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Resolution #05-06-179 adopting Findings of Fact #0722, a variance to the <br />maximum front yard setback, as established in Section 9.20.25(3)(b) of the Ramsey City <br />Code, is approved for the development oftownhomes on the Subject Property. <br /> <br /> <br />
