SECTION 4. PROHIBITION

During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning
and Subdivision of Land", no subdivision or platting of any land shall be permitted and no
applications for said subdivision or platting shall be accepted for the R-1 Rural Developing Zoning
District, as defined by the City's Official Zoning Map, revised February 28, 2006. Notwithstanding
the above prohibition of subdivision or platting of any land in the R-1 Rural Developing Zoning
District, any parcel of land in the R-I Rural Developing Zoning District that becomes eligible to
receive City sewer and water utilities through approval of a Comprehensive Plan amendment
approved by the City Council and Metropolitan Council may subdivide or plat land in accordance
with applicable City Code provisions.

SECTION 5. UNDUE HARDSHIP EXCEPTIONS

The City Council may grant an exception to the provisions of this Ordinance when, in its opinion,
undue hardship may result form strict compliance. In granting an exception, the City Council shall
prescribe any conditions that it deems necessa~ to or desirable for the protection of the public
interest. NO exception shall be granted unless the City Council finds:

That there are special circumstances or conditions affecting said property such that
the strict application of the provisions of this Interim Ordinance would deprive the
petitioner of the reasonable use of petitioner's land.

That the exception is necessary for the preservation and enjoyment of a substantial
property right of the petitioner.

That the granting of the exception will not be detrimental to the public welfare or
injurious to other property in the area in which the property is situated.

That the proposed exception will be harmonious with and in accordance with the
specific objectives of the City's existing Comprehensive Plan and will not adversely
affect the planning process for adoption of amendments to the Comprehensive Plan
above described.

That the proposed use/subdivision will be consistent with the intent and purpose of
this Ordinance.

SECTION 7. TERM

The term of this Ordinance shall be for a period of nine months. The term may be extended after
approval by the City Council for additional periods as provided for in Minnesota Statutes, Section
462.355, Subd. 4.
