CHARTER CASE <br /> <br /> COUNCIL VACANCY APPOINTMENT <br />By: James E. Norman, City Administrator <br /> <br />Background: <br /> <br />During a City Council work session held on October 4, 2005, the City Council discussed the <br />policy related to Council appointments in case of a City Council vacancy. Current vacancies are <br />filled according to a provision in Section 4.5 of the City Charter entitled Vacancy of Municipal <br />Elected Office, The Charter language spells out a process for appointment of a Councilmember <br />if a vacancy occurs within 365 of the unexpired term of a Councilmember. Vacancies that take <br />place with more than 365 days are filled by a special election. <br /> <br />During a Council work session of October 4, 2005, the City Council expressed a desire for the <br />appointment period to be extended and that a special election only be held if there is time for the <br />special election to be held during a General Election when there is more than two years <br />remaining on the unexpired tenn. The City Council directed the matter to be forwarded to the <br />Charter Commission for a discussion.
