CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR VACATION OF EASEMENT <br /> <br />IN THE PROPOSED PLAT OF BROOKFIELD FIRST ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />As part of tonight's agenda, the City Council is reviewing the proposed final plat of Brookfield <br />Second Addition. There are underlying road and drainage and utility easements on the property <br />that will need to be vacated. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Notification: <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed final plat of Brookfield 2"d Addition (portion) <br />Proposed ordinance <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public heating to vacate easements. <br /> <br />Observations: <br /> <br />The plat of Brookfield includes the former Lot 1, Block 3 of Now and Then Estates, which <br />included, the standard drainage and utility easements. Now that this lot is being replatted as a part <br />of Brookfield Addition, these easements need to be vacated. New drainage and utility easements <br />will be dedicated for the newly created lots in this portion of the Brookfield plat. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the ordinance to vacate the drainage and utility easements <br />within Lot 1, Block 3, Now and Then Estates. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #06- to vacate the drainage and utility easements on Lot 1, <br />Block 3, Now and Then Estates. <br /> <br />Review Checklist: <br />Asst.
