TRANSPORTATION AND LANDSCAPING i~Trail Development and Fees. The City Council has enacted a trail development fee in the amount of Five Hundred Eighty Dollars and no cents ($580.00) per unit. The existing homestead on ~~ is exempt from Trail Development Fee requirements. Therefore, a payment in the amount of Forty-One Thousand Seven Hundred Sixty Dollars and no cents ($41,760.00) (72 lots x $580.00/lo0 shall be paid to the CITY prior to releasing the Plat for recording. These monies, together with the Park Dedication (Paragraph #16) shall be available for construction of a ten-foot bituminous trail from the Trott Brook trail terminating at the intersection of Nowthen Boulevard along the north side of the Plat, along Nowthen Boulevard (CSAH 5) south to 167a' Avenue, as a Stage I Improvement. The plans for the trail construction shall be received by the CITY for approval within 90 days from the date of final plat approval and prior to the release of the plat for recording. The City shall reimburse the developer at a unit price of $17 per foot for the length of trail constructed outside the limits of the Plat. ~Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations prescribed by the CITY, not to exceed 5%. Sidewalk construction will occur along 170th Avenue,170th Trail 169th Avenue, Garnet Street and Feldspar Street. The costs associated with sidewalk construction are not eligible as a credit towards the Trail Development Fees and~or Park Dedication requirements due on the Plat. 19. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall be ~ accordance with the approved Landscape Plan and Tree Inventory prepared by Passe Engineering, dated April 6, revised . The trees to be protected during construction must be identified on the grading plan, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. The approved Plan generally requires 2 trees per lot, with the exception of the following lots which require additional landscaping for density transition purposes: Lots 1 and 8 Block 4 Lots 1, 5, and 6, Block 5 All required landscaping must be in place prior to the release of a Certificate of Occupancy for all lots in the plat, or a surety for same must be deposited with the Building Department. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: a) Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) For trees intended to be planted between the sidewalk and the street, the specific locations must be staked in advance of planting and approved by the CITY.
