TRANSPORTATION AND LANDSCAPING <br /> <br />i~Trail Development and Fees. The City Council has enacted a trail development fee in the <br /> amount of Five Hundred Eighty Dollars and no cents ($580.00) per unit. The existing <br /> homestead on ~~ is exempt from Trail Development Fee requirements. <br /> Therefore, a payment in the amount of Forty-One Thousand Seven Hundred Sixty Dollars <br /> and no cents ($41,760.00) (72 lots x $580.00/lo0 shall be paid to the CITY prior to releasing <br /> the Plat for recording. These monies, together with the Park Dedication (Paragraph #16) <br /> shall be available for construction of a ten-foot bituminous trail from the Trott Brook trail <br /> terminating at the intersection of Nowthen Boulevard along the north side of the Plat, along <br /> Nowthen Boulevard (CSAH 5) south to 167a' Avenue, as a Stage I Improvement. The plans <br /> for the trail construction shall be received by the CITY for approval within 90 days from the <br /> date of final plat approval and prior to the release of the plat for recording. The City shall <br /> reimburse the developer at a unit price of $17 per foot for the length of trail constructed <br /> outside the limits of the Plat. <br /> <br />~Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br /> CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br /> prescribed by the CITY, not to exceed 5%. Sidewalk construction will occur along 170th <br /> Avenue,170th Trail 169th Avenue, Garnet Street and Feldspar Street. The costs associated <br /> with sidewalk construction are not eligible as a credit towards the Trail Development Fees <br /> and~or Park Dedication requirements due on the Plat. <br /> <br />19. Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall <br />be ~ accordance with the approved Landscape Plan and Tree Inventory prepared by Passe <br /> Engineering, dated April 6, revised . The trees to be protected <br /> during construction must be identified on the grading plan, and the plan must require the <br /> installation of 'tree save fences' prior to land clearing or grading. The approved Plan <br /> generally requires 2 trees per lot, with the exception of the following lots which require <br /> additional landscaping for density transition purposes: <br /> <br />Lots 1 and 8 Block 4 <br />Lots 1, 5, and 6, Block 5 <br /> <br />All required landscaping must be in place prior to the release of a Certificate of Occupancy <br />for all lots in the plat, or a surety for same must be deposited with the Building Department. <br /> <br />In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: <br /> <br />a) Minimizing the impact of construction on trees in accordance with Minnesota <br /> Extension Service publication "Protecting Trees From Construction Damage" <br /> (Publication #NR-FO-6135-S). <br /> <br />b) For trees intended to be planted between the sidewalk and the street, the specific <br /> locations must be staked in advance of planting and approved by the CITY.
