<br /> WHEREAS, on February 28, 2006, pursuant to Resolution No. 06-02-064, the CITY
<br />approved the final plat of the Subject Property, which plat is known as MEADOW (the "Plat"),
<br />which approval is contingent on certain requirements, including the DEVELOPER and the
<br />CITY entering into this Agreement; and
<br />
<br /> WHEREAS, on April 25, 2006, the City Council reviewed the revised final plat,
<br />rescinded Resolution #06-02-064 and adopted Resolution #06-04- granting approval of the
<br />revised final plat; and
<br />
<br /> WHEREAS, the revised final plat for the Subject Property conforms to the preliminary
<br />plat for Meadow; and
<br />
<br /> WHEREAS, the DEVELOPER has received approval from the Metropolitan Council of
<br />the request for Comprehensive Plan Amendment to reconfigure the Subject Property's land use
<br />designations in the City's Comprehensive Plan, which designations consist of places to shop, low
<br />density residential, and public-quasi-public; and
<br />
<br /> WHEREAS, the CITY requires certain improvements to be constructed within the Plat,
<br />which improvements are defined as Stage I and Stage II Improvements in the City Code; and
