No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to <br />the lot is provided including the installation of at least one layer of bituminous surfacing; <br />(b) all utilities are in place, operational and accepted by the CITY; (c) for lots that have a <br />slope of less than 2%, a certificate of grading, prepared by a licensed (State of <br />Minnesota), professional land surveyor, must be provided to the City documenting that <br />the flattest grade on this lot is 1% or greater will require certificates of grading; and (d) <br />boulevard sod and landscape tree, or escrow for sa.me, have been provided. <br /> <br />18. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Cash Contribution. The Meadow Plat is located in the Prairie Recreation District. Park <br />dedication requirements shalI be satisfied by a cash payment. The Plat is creating forth- <br />six (46) new residential lots, which equates to a cash payment of One Hundred Ten <br />Thousand Four Hundred Ten Dollars and no cents ($110,400.00) (46 lots x $2,400/1o0. <br />Outlots A and B are exempt from park dedication requirements until such time as they are <br />replatted for development. The three (3) existing homesteads (Lots 1-3, Block 1) and the <br />existing dental clinic (Lot 7, Block 2) are exempt from the Park Dedication Fee. This <br />payment shall be made to the City prior to the release of the Final Plat for recording. <br /> <br />19. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />_Trail Development Fees. The.City Council has enacted a trail development fee in the <br />~mount of Five Hundred Eighty Dollars and no cents ($580.00) per residential unit. <br />Therefore, a payment in the amount of Twenty Six Thousand Six Hundred Eight Dollars <br />and no cents ($26,680.00) (46 lots x $580/lo0 shall be paid to the CITY prior to releasing <br />the Plat for recording. The three (3) existing homesteads (Lots 1-3, Block 1) and the <br />commercial lots (Lots 7 and Outlot B, Block 2) are exempt from the Park Dedication Fee. <br />A portion of the trail construction described in Item #20 is eligible for credit against the <br />Trail Fees due on the Plat. <br /> <br />20. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance <br /> with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in <br /> locations prescribed by the CITY, not to exceed 5%. Sidewalk construction will occur <br /> along both sides of Helium Street N.W., 152nd Way N.W., IQypton Terrace N.W., and <br /> along the north side of 152nd Lane N.W. The costs associated with sidewalk construction <br /> are not eligible as a credit towards the Trail Development Fees and/or Park Dedication <br /> requirements due on the Plat. <br /> <br />21. Trail Construction. The DEVELOPER shall construct a trail adjacent to Nowthen <br /> Blvd. N.W. from Alpine Drive N.W., south to 150th Lane N.W.
