CC Regular Session 7.6. <br />Meeting Date: 06/ 13/2023 <br />Submitted For: Stephanie Hanson, Community Development <br />By: Stephanie Hanson, Community Development <br />Information <br />Title: <br />Adopt Ordinance #23-11 Granting Centerpoint Energy Nonexclusive Franchise and Public ROW Access <br />Purpose/Background: <br />On May 23, 2023, City Council introduced Ordinance #23 -11, Granting Centerpoint Energy Nonexclusive <br />Franchise and Public ROW Access. <br />Adopted Ordinance #03-16 Granting Centerpoint Energy Nonexclusive Franchise and ROW Access became <br />effective on August 11, 2003 for a term of twenty (20) years. The ordinance is set to expire August 11, 2023. <br />Proposed Ordinance #23-11 will replace the existing ordinance and have a term of twenty (20) years, expiring on <br />July 16, 2043. <br />Centerpoint Energy has been part of the ordinance process and supports the draft language and term. <br />Notification: <br />The proposed ordinances does not require a public hearing or notification. <br />Time Frame/Observations/Alternatives: <br />Once approved, the Ordinance will be published on June 16, 2023 for a period of thirty (30) days. The Ordinance <br />will be effective on July 16, 2023. <br />Alternative 1: Adopt Ordinance #23-11 <br />Alternative 2: Deny Ordinanace #23-11. If denied, the City will not have regulations or fee collections for work in <br />the city right-of-way. <br />Funding Source: <br />This ordinance is being handled as part of normal staff duties. Also, any time work is completed, the City collects <br />a right-of-way permit fee from Centerpoint. In 2022, the City collected $1,755. 2023 fees are as follows: <br />Boring/Open Trench $ 9 5 + $15 per driveway <br />Road Closing $20 <br />Bond Per Mile $101000 <br />Recommendation: <br />Staff recommends City Council adopt Ordinance #23-11. <br />Outcome/Action: <br />Motion to waive the City Charter requirement to read the ordinance aloud and to adopt Ordinance #23 -11, <br />Granting Centerpoint Energy Nonexclusive and Public Right -of -Way Access. <br />Attachments <br />
