Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br />RESOLUTION #23-121 <br />RESOLUTION APPROVING A VACATION OF DRAINAGE AND UTILITY <br />EASEMENTS IN HY-10 RAMSEY 4TH ADDITION <br />RECITALS <br />The City of Ramsey is proposing a vacation of certain platted street right-of-way and drainage <br />and utility easements (the "Easements") on and adjacent to the property generally north of <br />147th Avenue NW at Ferret Street NW and legally described as follows: <br />Lot 3, Block 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br />(the "Subject Property") <br />2. That the Subject Property is owned by National Growth LLC. <br />3. That the City Council held a public hearing pursuant to Section 117-56 (Easement Vacation) <br />of the Ramsey City Code and Section 12.6 of the City Charter on June 13, 2023, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />available. <br />4. That these Easement are no longer necessary for the public's use with the anticipated <br />reconstruction of Ferret Street NW. <br />FINDINGS OF FACT <br />1. That the Easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br />2. That the Easement vacation is necessary to accomplish the City's intended purpose for <br />reconstructing Ferret Street NW. <br />3. That new roadway and drainage and utility easements will be dedicated by a separate document <br />for the northerly extension of Ferret Street NW. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants approval of a vacation of the Easements on <br />and adjacent to the Subject Property, as shown on Exhibit A. <br />
