Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-03-098A <br /> <br />A RESOLUTION TO UPHOLD THE DECISION OF THE BOARD OF ADJUSTMENT <br />AND DENY THE ISSUANCE OF A VARIANCE TO CUL-DE-SAC LENGTH OF <br />ERKIUM STREET IN THE PROPOSED PLAT OF SHADE TREE CREEK. <br /> <br /> WHEREAS, Shade Tree Communities (Permittee) has properly applied for a variance <br />from the maximum cul-de-sac length prescribed in Section 9.50.30, Subd. 4(g) on the property <br />generally located south of 177th Avenue and Erkium Street, legally described as, <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, Range 25, <br />Anoka County, Minnesota. <br /> <br />Subject to an easement for road purposes over the west 66.00 feet of the east 250.81 <br />feet thereof. <br /> <br /> WHEREAS, the Board of Adjustment met on February 2, 2006, convened the public <br />hearing and tabled the application relating to the request for a variance from the maximum cul- <br />de-sac length requirements on the Subject Property; and, <br /> <br /> WHEREAS, the Board of Adjustment met on March 3, 2006, convened the public <br />heating and denied the application relating to the request for a variance from the maximum cul- <br />de-sac length requirements on the Subject Property; and, <br /> <br /> WHEREAS, the City Council met on March 28, 2006 and considered the request for an <br />appeal to the Board of Adjustment's decision to deny the variance. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0756, the decision of the Board of Adjustment should be upheld and <br />a variance to the 600-foot cul-de-sac length, as established in Section 9.50.30, Subd. 4(g) of the <br />Ramsey City Code, is hereby denied for the Subject Property for Erkium Street NW. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Jeffrey, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Elvig <br />Councilmember Jeffrey <br />Councilmember Olson <br />Councilmember Pearson <br />Councilmember Strommen <br /> <br /> <br />
