Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-03-099 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0757 RELATING TO A REQUEST <br />FOR PRELIMINARY PLAT APPROVAL OF A SUBDIVISION PROPOSED TO BE <br />NAMED SHADE TREE CREEK <br /> <br /> WHEREAS, Shade Tree Communities, hereinafter referred to as "Applicant," has <br />properly applied for preliminary plat approval of Shade Tree Creek addition on the following <br />described property located in the City of Ramsey: <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, <br />Range 25, Anoka County, Minnesota. <br /> <br />Subject to an easement for road purposes over the west 66.00 feet of the east <br />250.81 feet thereof. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That Section 9.20.11 (R-1 Residential District) of the City Code requires all subdivisions <br /> in the Rural Developing ama to be developed as a cluster subdivision. <br /> <br />That on May 5, 2005, the Planning Commission reviewed the sketch plan and determined <br />that the proposed density transitioning was not adequate and provided additional <br />comments regarding the proposal. <br /> <br />o <br /> <br />That on December 30, 2005, the City received the application for preliminary plat of <br />Shade Tree Creek consisting of approximately 40 acres to be developed with 16 lots and <br />access to these lots is proposed by a 1,100 foot cul-de-sac that exceeds the 600 foot <br />maximum length established by City Code. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on February 2, 2006, continued to March 3, 2006 and said public hearing <br />was properly advertised, and the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That on February 2, 2006, the Planning Commission reviewed the application for <br />preliminary plat, and took action to table the application in order to receive additional <br />information regarding the soils and the location and design of the community septic <br />system. <br /> <br />o <br /> <br />That on March 3, 2006, the Planning Commission reviewed the application for <br />preliminary plat, and recommended to deny the plat based on the following reasons: the <br />public safety hazard of allowing the development with only one access and an over- <br />extended cul-de-sac, and the insufficient amount of density transitioning. <br /> <br /> <br />
