If any person; without authority of <br />law, and without first paying the costs due, sh~/I taKe <br />any impounded l~ors~ out of the enclosure in whic~ it is <br />impounded, he shall be guilty of a ~isd~,~eanor. <br />Costs incurred by the city in impounding horses running <br />at large shall be paid by the owner of the horse prior <br />to releasing said horse. No such horse impounded sh~ll <br />be released except to a person displaying a receip~ frog <br />the city clerk showing payment of the reasonable costs <br />of impounding, cost of feeding and veterinarian care, if <br />requi red. <br /> If any horse impounded is not redee;~ed wihin fourteen <br /> days, ~he chief of police or his designated agent shall <br /> give an additional three days notice of tY~e ti;.~e and <br /> place where such horse will be sold by posting and <br /> serving notices as required for notice herein. If such <br /> horse cannot be sold on the day stated, it may be sold <br /> as soon as possible thereafter without notice· <br /> The city clerk shall turn over the proceeds of any sale <br /> to the city treasurer. On order of the city council, <br /> the city treasurer shall pay to the owner of such horse <br /> the difference between the sale price, after deduc~in~ <br /> the cost of impounding, feeding and sales charges, if <br /> the owner ~akes claim for tile monies within one year <br /> fro~,~ '~he date of sale; otherwise, it shal~ be forfeited <br /> to the city. <br /> i~o person may ride or drive a horse after sunset and <br /> before sunrise long or crossing any public way witnou~ <br /> appropriate ligating or reflectorized clothing <br /> ~o person nay ride or drive a horse in any public park, <br /> beach, golf course or other public property except <br /> within ~he right-of-way of public streets and high,Jays <br /> and in areas duly Qesignated as a trail or hitching <br /> area. <br /> The City Council shall designate and properly post those <br /> areas in public lands and parks where horses may be <br /> ridden. <br /> Every person riding a horse or driving any horse-drawn <br /> vehicle upon a public roadway shall be subject to those <br /> provisions of the city code applicable to the driver of <br /> a motor vehicle, except those provisions which by their <br /> natur: nave no application. <br /> No horse shall be ridden or driven in any manner w~ich <br /> would cause undue damage to any haro-sur~aced roaa. <br /> <br /> <br />
