tion performed by an approved and qualified consultant. <br /> <br />ll0.1gg NONCONFORMING USES. <br />A person keeping wild animals within the City upon the eft[active <br />date of the adoption ol this ordinance, who does not con:[orm to the <br />provisions of this ordinance shall be given 30 days to comply or submit <br />application lor the necessary variances. <br /> <br />110.189 ENFORCEMENT <br />Subdivision I. Impoundment. In addition to the penalties imposed <br />in ll0.1$g, a person in violation of this ordinance may be subject to <br />having the wild animals in question impounded, or destroyed. Owners <br />in violation of this ordinance will have ten days to correct the viola- <br />tion and redeem a wild animal. The owner is responsible for all costs <br />incurred by the City to capture, keep and/or destroy a wild animal. <br />l:[ a wild animal is not redeemed, the City will dispose ot such wild <br />animal in an)' manner it deems necessary such as (but not limited <br />to) se/ling, destroying, or donating to an appropriate organization <br />or agency. <br /> Subdivision 2. Rabies. A wild animal capable o;[ transmitting rabies <br /> which has been known to have bitten a person shall be quarantined <br /> and observed ;[or rabies under the direction o;[ a licensed veterinarian <br /> for a period of time and in facilities determined to be adequate by <br /> that veterinarian and the Git),. If a wild animal is proven to be rabid, <br /> the wild animal shall be destroyed. Ifa wild animal is proven to not <br /> be rabid by a licensed veterinarian, it will be returned to the owner. <br /> Subdivision 3. Enforcement AuthSrity. Enforcement officers shall <br /> have the right to destroy a wild animal posing an immediate threat <br /> of serious harm to any persons livestock or house pet. <br /> <br />ll0.1gl0 PENALTY <br /> <br />A person who fails to comply with or violates provisions of the ordi- <br />nance or the restrictions of a conditional use permit, wild animal <br />license or variance shah be subject :o a fine of not more than $700 <br />for each day when the violation persists and/or imprisonment :~or <br />a period no~'exceeding 90 days, or maximum penaky allowed ~>' law, <br />such ~ine and imprisonmen~ being pursuant :o ~he provisions o~ Minne- <br />sota Sta~u~e Chapter 335. Appropriate actions and proceedings may <br />be ~aken by law or inequity to prevent a violation of this ordinance <br />or ~he condkions or reswic:lons ol a condkonal use permk, wild <br />animal license~ or variance~ ~o preven~ unlawful construction) ~o re- <br />cover damages~ to res~rMn, correct or abate a violation, and to preven~ <br />H]ega] use of a ]o~ these remedies shall be Jn addJ;]on to ~he penalizes <br />described above. <br /> <br /> <br />
