The Board of Adjustment met on May 5, 2006, and voted to deny the variance to maximum cul-
de-sac based on the enclosed findings.

Due to the encumbrance of wetlands on this site, any development of this property would require
a variance to cul-de-sac length without obtaining additional land or a second access through the
property. However, the Fire Chief has indicated that allowing an over-extended cul-de-sac may
impact the public safety in an emergency. Vehicles will have difficulty entering, existing, and
maneuvering within the neighborhood. It is Staff's opinion that ensuring public safety is more
compelling than easing a hardship caused by wetlands. Therefore, Staff recommends denial of
the variance due to the increased potential for public safety hazard.

City Council Action:

Motion to adopt Resolution #06-05- adopting Findings &Fact #
from Ron Tallman to appeal the Board of Adjustment's decision,

-and-

Motio.n. to approve the request for a variance to maximum cul-de-sac length on the Subject
Property; based on the £mdings of fact, and adopt Resolution #06-05- declaring terms of

-or-

relating to a request

Motion to adopt ResolUtion #06-05-
the based on the findings of fact.

· to uphold the Board &Adjustment's decision and deny

Review Checklist:
Assistant Community Development Director/HRA Director
Fire Chief

CC: 5/9/06

-174-
