Case <br /> <br />ADOPT ORU[NANCE"A~MENDI~G SECT1ON $:35:(REGULATION' OF SINGLE <br />FAMILY DWELLINGS TO BE MOVED INTO OR WITHIN THE CITY) <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br />Moving a dwelling'into or within the City requires a Dwelling Moving Permit (DMP). <br />However, there are no standards or permit requirements to move a dwelling out of the <br />City or for moving an accessory building into, within, or out of City limits. Currently, <br />the DM? process requires that the request is presented to the Planning Commission and <br />then ultimately to City Council. The process requires approximately two (2) months <br />from the time an application is received until City Council votes on the matter. Since the <br />regulations for moving a dwelling into or within the City are in Chapter 8 (Building & <br />Housing) of City Code and not Chapter 9 (Zoning & Subdivision of Land), a public <br /> hearing is not required when amending this section. However, because a request for a <br /> · · · · City Council's purview, Staff did <br /> DM? currently is under the Planning Commission and <br /> present the proposed amendment to thc Planning Commission at the April 6, 2006 <br /> meeting. <br /> <br /> The following items are enclosed for your information: <br /> A. Proposed Ordinance to amend Section 8.35 <br /> B. Draft City Council meeting minutes dated April 25, 2006 <br /> <br /> Observations: <br /> The proposed revisions are aimed at accomplishing several things. First, provisions have <br /> been included that would require a Moving permit to be obtained from the Building <br /> Division if a dwelling were to be moved out of the City or if an accessory building <br /> (greater than 120 square feet in size) were to be moved into, within, or out of the City. <br /> After conferring with the Building Official, this type of permit will allow thc City to <br /> verify, prior to a building being raised and relocated, that all utilities have been properly <br /> shut off and/or capped and that the foundation is properly removed and/or backfilled. <br /> Secondly, the entire DM? process would be streamlined by eliminating the need for the <br /> request to be presented to both the Planning Commission and City Council. While City <br /> Staff would now have the ability to administratively approve or deny a DM? application, <br /> the conditions and criteria currently used to evaluate this type of request would remain in <br /> tact. <br /> ordinance on April 6, 2006.
