Councilmember moved for the adoption of the following findings of fact: RESOLUTION #06-04- A RESOLUTION 'ADOI'TINGFINIIINGF'OF"FACT, 4f' .RELATING TO'~A~ REQUEST FOR A CONDITIONAL USE PERMIT FOR A 120-FOOT MONOPOLE COMMUNICATIONS TOWER. WHEREAS, Cingular Wireless, Inc., hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit to construct and operate a monopole communications tower ("Tower") on the property located at 6305 Green Valley Rd. and legally described as follows: Lot 4, Block I, Valley View Acres, Anoka County, Minnesota (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on April 6, 2006, and that said public hearing was properly advertised and that the minutes of said public heating are hereby incorporated by reference. That the Subject Property is located in the R-1 Rural Preserve and is approximately 9.27 acres in size, and is owned by Jeff and Caroline Rowe. -_.That the Subject Property is ldcated in the Tower Overlay District which allows for communications towers up to 120 feet in height on parcels that are greater than 10 acres. 10. -268- That the Applicant has submitted a variance to the minimum lot size requirement in order to allow for a communications tower to be constructed on the Subject Property. The Applicant's variance request will be considered by the Board of Adjustment on April 6, 2006. That the Applicant is proposing to lease a 50 foot by 65 foot portion of land on the Subject Property (Site) to facilitate the construction and operation of the Tower. That the property to the north and west are zoned R-I Rural Preserve and the properties to the south and east are zoned R-1 Rural Developing. That the Applicant is proposing to construct a 120-foot monopole communications tower with a fenced in 50' x 65' equipment area, which will also contain an equipment shelter that will be 12' x 20'. 'That ~City 'Code esta'blishes a setback for towers ~f~ne ~md .'half-times~the ,height of.the tower. That ihe proposed tower located on the Subject ?roperty will need to be at least 180 feet from any property line.
