PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Minimum Lot Size in the Tower Overlay <br />District for a Monopole Communications Tower; Case of Cingular Wireless <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:10 p.m. in <br />order to conduct the public heating. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public heating to order at 7:10 p.m. <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik explained that the City has received an <br />application from Cingular Wireless to construct and operate a monopole communications tower <br />at 6405 Green Valley Road. A conditional use permit is also required for the construction of a <br />communications tower and that request, which was tabled at the Mamh meeting due to the need <br />for a variance to minimum lot size, will be presented during the Planning Commission meeting. <br /> <br />Assistant Community Development Director Frolik stated towers are permitted in residential <br />districts as long as they are located in the Tower Overlay District and are at least 10 acres in size. <br />The subject property is located within the Tower Overlay District but is 9.27 acres in size. A <br />variance is necessary to allow for the cell tower to be located on the Rowe lot. <br /> <br />Assistant Community Development Director Frolik stated while the lot size is just short of that <br />required by City Code, Staff believes that this is a valid request, based on several factors. First, <br />standards of City Code permitted the creation of this lot as a remnant parcel. Secondly, if the <br />tight-of-way area is included, this lot would exceed the minimum size requirements. Therefore, <br />Staff is recommending that the request be approved. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Board Member Levine, seconded by Board Member Nixt, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Cleveland, <br />Hunt, and Ttites Rolle. Voting No: None. Absent: Commissioner Van Scoy. <br /> <br />The public hearing closed at 7:10 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:10 p.m. <br /> Board of Adjustment/April 6, 2006 <br /> Page 2 of 3 <br /> <br /> <br />
