Subdivision 3. Rejection of Applications Except in the case of exceptions set forth in Minnesota Statutes Section 364.09, as may be amended from time to time, if the City rejects an application for employment due partly or solely to the applicant's prior conviction of a crime which relates directly to the position sought, the City's Human Resources Manager will notify the applicant in writing of the following: the grounds and reasons for denial; the applicant complaint and grievance procedure set forth in Minnesota Statute Section 364.06, as may be amended from time to time; the earliest date the applicant may reapply for employment or a volunteer position; and that all competent evidence of rehabilitation will be considered upon reapplication. Only public conviction information related directly to the position sought will be considered in denying employment. In situations where identity is questioned, fingerprint verifications will be allowed. SECTION 2. SUMMARY The following is the official summary of Ordinance #06-13 as adopted by the City Council. Ordinance #06-13 repeals Section 3.20 of the City Code titled "Personnel Policy" and indicates that the personnel policy has been adopted by resolution and will be amended by resolution in the future. Ordinance #06-13 also amends Section 3.14 by granting the Ramsey Police Department authorization to conduct pre-employment criminal background checks. (The language regarding background checks was previously found in Section 3.20.24.) SECIION 3. EFFECTIVE DATE This Ordinance becomes effective upon its passage and thirty (30) days after its publication according to law.
