product is necessary to evaluate the regulatory options available to the City and is for the <br />purpose of protecting the health and safety of Ramsey's residents. <br />E. Upon passage of the aforementioned legislation, further discussion occurred nationally and in <br />Minnesota about expansion of the allowance of THC and chemically related products that were <br />outside of the express regulation provided in Minnesota. Regulation of such things as locations <br />of distribution points of any and all kinds of THC products and any chemically related product <br />are matters of immediate concern as they relate to the health and safety of the citizens of <br />Ramsey. It is necessary, in order to protect the health, safety and welfare of the citizens of the <br />City to have as broad a study as possible in this area prior to allowing the sale and/or <br />distribution of any such products within the City. <br />F. The City of Ramsey will work with the Office of Cannabis Management to develop ordinances <br />for reasonable restrictions on the time, place, and manner of the operation of a cannabis <br />business or hemp business; develop standardized forms and procedures for the issuance of <br />retail registration pursuant to section 342.22; and develop model policies and procedures for <br />the performance of compliance checks required under section 342.22. <br />SECTION 2. STUDY <br />The City Council hereby authorizes and directs City Staff to conduct a study of the issues relating <br />to the sales, testing, manufacturing, and distribution of THC Products and chemically related <br />products. Staff will then make a recommendation to the City Council about whether the City <br />should amend its zoning, business licensing, or other general Code provisions related to these types <br />of uses to better protect the residents of Ramsey. <br />SECTION 3. MORATORIUM <br />In accordance with the findings set forth herein, a moratorium is established as follows: <br />A. No business, person, or entity may establish a new use or expand an existing use that <br />includes or involves the sale, testing, manufacturing, or distribution of THC Products or <br />chemically related products for a period of twelve (12) months from the effective date of <br />this Ordinance or until the City Council repeals this Ordinance, whichever occurs first. <br />B. During the term of this Ordinance, the City Staff will not issue any license or permit, nor <br />will it accept or process any applications for uses related to the sale, testing, manufacturing, <br />or distribution of THC Products or chemically related products. <br />C. The moratorium established by this Ordinance does not apply to the sale, testing, <br />manufacturing, or distribution of products that were lawful prior to enactment of the new <br />law relating to THC Products and chemically related product. <br />SECTION 4. ENFORCEMENT <br />In addition to any criminal penalties allowed by law, the City may enforce this Interim Ordinance <br />by injunction or any other appropriate civil remedy in any court of competent jurisdiction. A <br />violation of this Ordinance is also subject to the City's general penalty in Section 2-333 and Section <br />2-334 of Ramsey City Code. <br />Ordinance #23-09 <br />Page 2 of 4 <br />
