Goodrich
city Attorney

In 1979, the city and Barthel Homes, Inc. entered into an
agreement relating to certain unbuildable lots in that
subdivision. A copy of that agreement is enclosed. Barthels now
desire to obtain building permits on certain of these lots.
city staff believe that the most efficient manner of
handling this would be for the Council to authorize the City
Building Inspector and city Engineer to make the determination of
whether each lot is buildable and/or the appropriateness of
proposed measures to make a lot buildable.

Council Action:
After discussion of above, and if Council agrees, the
following motion should be considered:

Motion: To authorize the city's Building Inspector, city
Engineer and city Administrator to approve building permit
requests on behalf of the city Council for the following
described property to-wit.
Lots 9, 10, 11, and 12, Block 6;
Lot 3, Block 7;
Lot i, Block 9; all in BARTHEL'S.
