Minutes CASE ~: <br /> <br /> REAL PROPERTY AND EASEMENT <br /> ACQUISITION FOR FRONT STREET <br />By: Dave Hartley, City Adminlstrator <br /> <br />Background: <br /> <br />At its iasc regular meeting, the City Council authorized the Mayor and City <br />Administrator to execute real property and easement acquisition agreements in <br />order to acquire land for the construction of Front Street N.W. with sanitary <br />sewer and water improvements. The final form of those agreements is attached <br />along with a letter of transmittal which requires that these agreements be <br />signed no later than February 5, 1988. These agreements reflect the <br />understanding of all parties and the signing of these documents is the <br />codification of those understandings. <br /> <br />In the event that the owners do not sign these agreements, the City Council may <br />wish to consider its power of eminent domain and begin condemnation <br />proceedings. To do this, the City Council should consider the adoption of a <br />resolution authorizing its City Attorney to commence "quick take" condemnation <br />procedures. <br /> <br />Recommendation: <br /> <br />It is proposed and recommended by City Attorney Goodrich and myself that the <br />City Council adopt a resolution authorizing the City Attorney to initiate <br />"quick take" condemnation procedures for the property within the proposed right- <br />of-way of Front Street N.W. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Resolution #88- authorizing the City Attorney to initiate a <br />"quick take" for property needed for road right-of-way (frontage road <br />south of U. S.
