Absent: Commissioners LaDue, <br />Nowell and Shumway. <br /> <br />~O~RD OF ADJUSTMENT BUSINESS <br />Sase ~1: Hc~uest For Vsrlsnee From Accessory Structure Maximum ~ei~ht ~ <br /> Allowance: Case Of Mr. Jeff Erikson: <br /> <br /> Mr. Erikson was present. <br /> chairman Zimmerman noted that the City Attorney has determined that even <br /> though the property is located in the B-1 Business district, the principal <br /> use of the property is residential; therefore, Mr. Erikson's accessory <br /> structure should be subject to residential standards. <br />'Ms2 Norris noted that the 16 foot height limitation for accessory <br />structures applies'to commercial and industrial zones as well as <br />residential zones. Ms. Norris also noted that the City Attorney has also <br />stated that if Mr. Erikson desires to use the accessory structure for <br />commerical purposes, he would have to go through the conditional use <br />process because his primary use of the property is residential. <br /> The Commission proceeded to review the proposed findings of fact. <br /> Motion by Commissioner Deemer and seconded by Commissioner Paterson to <br /> adopt Findings of Fact 0160 relating to Mr. Erikson's request for a <br /> variance from the maximum height allowance for accessory structures, <br /> amended as follows: <br /> Item #8 - Should read as follows: 'That the Applicant is proposing <br /> to construct an accessory structure approximately 22 feet in height, <br /> which is also higher than the principal structure.' <br /> Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br /> Eendriksen and Peterson. Voting No: None. Absent: Commissioners Howell, <br /> Shumway and LaDue. <br /> <br /> Motion by Commissioner Deemer and seconded by Commissioner Peterson to <br /> deny, based on the findings o3 fact, Mr. Erikson's request for a variance <br /> from the maximum height allowance for accessory structures. <br /> Motion carried.
