Councilmember Sorteberg introduced the motion to adopt the following findings <br />of fact regarding Harold Phelps subdivision request: <br /> <br />0O057 <br /> <br />') <br /> <br /> i> That the Applicant has properly applied for a variance to Section 170.0314B <br /> of the City Code. <br /> 2) That the property is legally described as Plat 89201 Parcel 6000 and is <br /> generally located at approximately 17&th and Erkium Street N.W. <br /> 3) That the property is zoned R-I, Residential, and is approximately 30 <br /> acres in size. <br /> <br />'4) That the subject property does not front on a public street and according <br />to Ordinance cannot be considered a buildable lot. <br /> 5) That other similar parcels within the City of Ramsey have been developed <br /> in this manner. <br /> <br /> 6) That other similar requests have in the past been denied by the city <br /> Council. <br /> 7) That the proposed easement to the property does traverse the floodway of <br /> Trott Brook. <br /> <br /> 8) That the City records do not indicate that Parcel 6000 and 5400 are in <br /> separate ownership, therefore, the need for a variance has not been established. <br /> 9) That the applicant would be utilizing a 1326 foot easement to obtain access <br /> to his property and this could hinder fire and police protection to that prop- <br /> erty. <br /> <br /> The motion for the adoption of the foregoing Findings of Fact were duly <br /> seconded by Councilmember Schlueter and upon vote being taken thereon, the <br /> following voted in favor thereof: <br /> <br /> Mayor Gamec, COuncilmembers Van Wagner, Sorteberg and Schlueter <br /> <br /> and the following members voted against the same: <br /> <br />None <br /> <br />· ~' fo,.ow-rig members were absent: <br /> Councilmember Re!mann <br /> <br />whereupon said rznczngs of P- ~ were duly ~assed and adopted by the Ramsey <br />CiTy Council this she 22nd day of February, !983. <br /> <br /> <br />
