Councilmember Woestehoff introduced the following resolution and moved for its adoption: RESOLUTION #23-158 RESOLUTION APPROVING USE RESTRICTION AGREEMENT FOR OUTLOT A, RAMSEY PROPERTIES ADDITION WHEREAS, the City of Ramsey, herein referred to as the “City,” owns various parcels throughout the City of Ramsey; and WHEREAS, Ramsey Properties, LLC ( the “Developer”) has requested the City approve a Use Restriction Agreement on 9.25 Acres of Outlot A, Ramsey Properties Addition that prohibits the development of a Hotel, limits the amount of Air BRB units to two and prohibits short term rentals of less than three months for buildings containing over 6 residential units; and WHEREAS, on May 11, the EDA reviewed a request by the developer and requested that the term of the use agreement be reduced from 10 years and that the geographical area be reduced from 20 acres; and WHEREAS, City Staff has worked with the developer and a potential market rate apartment developer and the form of the Use Restriction Agreement is acceptable to all parties; and WHEREAS, the purpose of the proposed use restriction agreement is to provide the Developer a five year period to open and achieve stabilization of a 98 unit Hilton Home2 Hotel. NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City hereby authorizes execution of the Use Restriction Agreement with a five year term commencing after the opening of the hotel limiting the development and operations on 9.25 acres of Outlot A, Ramsey Properties Addition. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Riley, and upon vote being taken thereon, the following voted in favor thereof: Mayor Kuzma Councilmember Woestehoff Councilmember Riley Councilmember Olson Councilmember Specht and the following voted against the same: Councilmember Howell Councilmember Musgrove
