6.03: PUBLIC HEARING for a Private Kennel License located at 7230 152nd Ave NW.

Presentation

Zoning Code Enforcement Officer Swalchick reviewed the staff report and request for a private
kennel license. He shared that there have been three police calls to this residence along with code
violations and as a result they found six dogs on the property. He noted that the dogs are a result
of the joining of a blended family. He stated that there was one barking dog compliant, one dog
at-large compliant, and one complaint concerning there being six dogs. He stated that he conducted
an inspection of the property and he found that the home and the dogs are well taken care of. He
noted that there are areas that need to be corrected in order to receive the private kennel license,
including the fence at the property and a potential underground fence. He noted that there was a
letter received from a neighbor concerning the public hearing and noted that this neighbor is also
the one who has been calling the police with concerns for three years. He requested conditions of
approval for this request.

Public Hearing

Mayor Kuzma called the public hearing to order at 8:09 p.m.

Citizen Input

Zack and Jami Lynn Bennewitz, the dog owners, came forward and shared about their blended
family and where the dogs have come from. Mr. Bennewitz stated that he did not know that this
many dogs was an issue.

Mrs. Bennewitz stated that she does not want to have any issues with the City and their pets are
their kids.

Councilmember Musgrove asked about the fences and the timeline of the repairs. She noted that
the case mentions a deadline of September 1 and asked if this could be done sooner.

Zoning Code Enforcement Officer Swalchick shared that they discussed this and that it was
considered a priority to take care of the fence first.

Councilmember Musgrove asked the Bennewitz’s if the repairs could be done before September 1
and if so what timeframe would be recommended for this.

Mr. Bennewitz stated that they are still deciding between a wireless or a physical fence. He stated
that they used to have an issue with a dog getting loose but have not in a long time. He stated that
there is also a section in the front where the chain link fencing is missing which has been patched
with chicken wire.

Mrs. Bennewitz stated that they are considering which option would be the best financially. She
said that their original plan was for an 8-foot privacy fence but it is too expensive for them. She
noted that they definitely want to get the work done before the September 1 date.
City Council / June 13, 2023
