ENCROACHMENT AGREEMENT <br />THIS AGREEMENT ("Agreement") is made this day of , 2023, by and <br />between the CITY OF RAMSEY, a municipal corporation under the laws of the State of Minnesota <br />("City"), and Ramsey Properties LLC, a Minnesota limited liability corporation, and their successors and <br />assigns ("Landowner"). <br />RECITALS: <br />WHEREAS, Landowner are the fee owner of the real property located at 7895 Sunwood Drive <br />NW, Ramsey, Minnesota, and legally described as follows: <br />Lot 1, Block 1, Ramsey Properties Addition, Anoka County, Minnesota <br />("Property"); and <br />WHEREAS, the City currently has ten (10) foot wide storm sewer easement along a portion of the <br />southwesterly boundary of the Property, as granted in that certain Grant of Permanent Easement of even <br />date herewith executed by Landowner (the "Easement"); and <br />WHEREAS, Landowner seeks permission from the City to partially encroach upon the Easement <br />up to a maximum of ten (10) feet with a permanent patio, knee wall, and landscape features into the <br />Easement. <br />NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good <br />and valuable consideration, the parties agree as follows: <br />1. The City hereby approves an encroachment over the Easement by Landowner for the purposes of <br />constructing and maintaining a patio, knee wall, and landscape features within the Easement legally <br />described and as shown on Exhibit A, subject to the terms of this Agreement. <br />1 <br />
