1 3. Be placed a minimum of ten feet from the ordinary high water level. <br />2 (5) Decks and patios in setback areas. Decks and at -grade patios may encroach into the required <br />3 setbacks from the ordinary high water level and blufflines without a variance, when consistent <br />4 with Section 920(I)and 920(J), provided that: <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />a. The encroachment of the deck or patio into the required setback area does not exceed <br />15 percent of the required structure setback; <br />b. The area of the deck or patio that extends into the required setback area occupies no <br />more than 25 percent of the total area between the required setback and the 15 <br />percent using the formula: [Required setback depth (feet) x 0.15 x lot width at setback <br />(feet) x 0.25 = maximum total area.] <br />c. Off -premise advertising signs must: <br />15 <br />16 <br />17 <br />Required <br />structure <br />setback (X) <br />in feet <br />1. Meet required structure placement and height standards in section 117-148(f) <br />(structure height and placement and lot size). <br />2. Not be readily visible. <br />18 b. Directional signs for patrons arriving at a business by watercraft must comply with the <br />19 following standards: <br />20 1. They must be consistent with Minn. Stats. § 86B.115. <br />21 2. Only convey the location and name of the establishment and the general types of <br />22 goods and services available, if located in a shore impact zone. <br />23 3. Be no greater than ten feet in height and 32 square feet in surface area; and <br />24 4. If illuminated, the lighting must be shielded to prevent illumination out across the <br />25 river or to the sky. <br />26 (7) Fences. Fences between principal structures and the river are allowed provided that fences <br />27 are: <br />28 a. Not higher than six feet. <br />29 b. Not located within 40 feet of slopes greater than 12%. <br />30 c. Not located in the regulatory floodplain. <br />31 (H) Performance standards for public facilities. <br />32 (1) Purpose.
