1 e. Erosion and sediment controls are maintained to ensure effective operation; <br />2 f. The proposed work is eonsistcnt with the vegetation standards in section 117 148(i) <br />3 (vegetation management); and- <br />4 g. Best management practices for protecting and enhancing ecological and water <br />5 resources identified in Best Practices for Meeting DNR General Public Waters Work <br />6 Permit GP 2004-0001. <br />7 (7) Compliance with other plans and programs. All development must: <br />8 a. Be consistent with Minn. Stats. ch. 103B, and local water management plans completed <br />9 under [Minnesota Rules] chapter 8410; <br />10 b. Meet or exceed the wetland protection standards under Minnesota Rules, chapter <br />11 8420; and <br />12 c. Meet or exceed the floodplain management standards under Minnesota Rules, <br />13 chapters 6120.5000-6120.6200. <br />14 (K) Subdivision and land development standards. <br />15 (1) Purpose. <br />16 a. To protect and enhance the natural and scenic values of the MRCCA during <br />17 development or redevelopment of the remaining large sites; <br />18 b. To establish standards for protecting and restoring biological and ecological functions <br />19 of primary conservation areas on large sites; and <br />20 c. To encourage restoration of natural vegetation during development or redevelopment <br />21 of large sites where restoration opportunities have been identified in MRCCA plans. <br />22 (2) Applicability. <br />23 a. The design standards in this section apply to subdivisions, planned unit developments <br />24 and master -planned development and redevelopment of land involving ten or more <br />25 acres for contiguous parcels that abut the Mississippi River and 20 or more acres for all <br />26 other parcels, including smaller individual sites within the following developments that <br />27 are part of a common plan of development that may be constructed at different times: <br />28 1. Subdivisions; <br />29 2. Planned unit developments; and <br />30 3. Master -planned development and redevelopment of land. <br />31 b. The following activities are exempt from the requirements of this section: <br />32 1. Minor subdivisions consisting of three or fewer lots; <br />33 2. Minor boundary line corrections; <br />34 3. Resolutions of encroachments; <br />35 4. Additions to existing lots of record; <br />36 5. Placement of essential services; and <br />37 6. Activities involving river -dependent commercial and industrial uses. <br />38 3) Application materials. Project information listed in section 117 148(c)(6) (application <br />39 materials) must be submitted for all proposed development. <br />40 (4) Design standards. <br />41 a. Primary conservation areas, where they exist, must be set aside and designated as <br />42 protected open space in quantities meeting the following as a percentage of total parcel <br />43 area: <br />44 1. CA-ROS District: 50 percent; <br />45 2. CA -RN District: 20 percent; <br />46 3. CA -SR District: Ten percent if the parcel includes native plant communities or <br />47 provides feasible connections to a regional park or trail system, otherwise no <br />48 requirement. <br />Page 114 of 160 <br />
