1 (6) All new principal structures must have vehicular access at or above an elevation not more than <br />2 two feet below the regulatory flood protection elevation, or must have a flood <br />3 warning/emergency evacuation plan acceptable to the city. <br />4 (7) Accessory uses such as yards, railroad tracks, and parking lots may be at an elevation lower <br />5 than the regulatory flood protection elevation. However, any facilities used by employees or <br />6 the general public must be designed with a flood warning system that provides adequate time <br />7 for evacuation if the area is inundated to a depth and velocity such that the depth (in feet) <br />8 multiplied by the velocity (in feet per second) would exceed a product of four upon occurrence <br />9 of the regional (one percent chance) flood. <br />10 (8) Interference with normal manufacturing/industrial plant operations must be minimized, <br />11 especially along streams having protracted flood durations. In considering permit applications, <br />12 due consideration must be given to the needs of industries with operations that require a <br />13 floodplain location. <br />14 (9) Flood fringe developments must not adversely affect the hydraulic capacity of the channel and <br />15 adjoining floodplain of any tributary watercourse or drainage system. <br />16 (10) Manufactured homes and recreational vehicles must meet the standards of section 927. <br />17 (C) Conditional uses. The following uses and activities may be allowed as conditional uses, if allowed in <br />18 the underlying zoning district(s) or any applicable overlay district, following the procedures in section <br />19 928(D). conditional uses must meet the standards in subsections (D)(4) through (10) above and <br />20 section 924(D). <br />21 (1) Any structure that is not elevated on fill or floodproofed in accordance with section 924(B)(1)a. <br />22 and b. <br />23 (2) Storage of any material or equipment below the regulatory flood protection elevation. <br />24 (3) The cumulative placement of more than 1,000 cubic yards of fill when the fill is not being used <br />25 to elevate a structure in accordance with [subsection] (b)(1) above. <br />26 (D) Standards for flood fringe conditional uses. <br />27 (1) The standards listed in sections 924(B)(4) through (10) apply to all conditional uses. <br />28 (2) Basements, as defined in section 105, are subject to the following: <br />29 a. Residential basement construction is not allowed below the regulatory flood protection <br />30 elevation. <br />31 b. Non-residential basements may be allowed below the regulatory flood protection elevation <br />32 provided the basement is structurally dry floodproofed in accordance with section 924(D)(3). <br />33 (3) All areas of nonresidential structures, including basements, to be placed below the regulatory <br />34 flood protection elevation must be floodproofed in accordance with the structurally dry <br />35 floodproofing classifications in the Minnesota State Building Code. Structurally dry <br />36 floodproofing must meet the FP-1 or FP-2 floodproofing classification in the Minnesota State <br />37 Building Code, which requires making the structure watertight with the walls substantially <br />38 impermeable to the passage of water and with structural components capable of resisting <br />39 hydrostatic and hydrodynamic loads and the effects of buoyancy. Structures wet floodproofed <br />40 to the FP-3 or FP-4 classification are not permitted. <br />41 (4) The placement of more than 1,000 cubic yards of fill or other similar material on a parcel (other <br />42 than for the purpose of elevating a structure to the regulatory flood protection elevation) must <br />43 comply with an approved erosion/sedimentation control plan. <br />44 a. The plan must clearly specify methods to be used to stabilize the fill on site for a flood event <br />45 at a minimum of the regional (one percent chance) flood event. <br />46 b. The plan must be prepared and certified by a registered professional engineer or other <br />47 qualified individual acceptable to the city. <br />48 c. The plan may incorporate alternative procedures for removal of the material from the <br />49 floodplain if adequate flood warning time exists. <br />Page 123 of 160 <br />
