1 (6) To defray the administrative costs of processing requests for an amendment to this 2 subdivision, a fee not exceeding administrative costs shall be paid by the petitioners. Such fee 3 shall be determined by the council. 4 (E) Conditional use permit review. 5 (1) A copy of all notices of any public hearing, or where a public hearing is not required, a copy 6 of the application to consider issuance of a conditional use permit shall be sent so as to be 7 received by the commissioner at least 30 days prior to such hearings or meetings to consider 8 issuance of a conditional use permit. A copy of the decision shall be forwarded to the 9 commissioner within ten days of such action. 10 {2) Conditional use permits relating -to privatc or commefcial recreational dcvclopme+tt must bc 11 certified in accordance with subsection (g) of this section. 12 {-G) Certification. 13 {1) Certain land usc decisions which directly affect the usc of land -within the Scenic Rivcr Land Use 14 District and involve any of thc following actions must bc certified by thc commissieA-cr a� 15 specified in subsection (g)(2) of this section. 16 a. or amending an efdinancc rcgulatingth c o land incl ding czoning of particular 17 tracts of thc land 18 b. Granting a variance from a provision of this subdivision that related to thc zonin 19 provisions of section 117 25€ and any other zoning -dime -Rs -Eon provisions established in Minn. 20 Rulcs pts. 61-05.1400-6105.15O0- 21 •c. Appre i-A-g a plat that is inconsistent with the local land usc. 22 d. Granting a conditional use -permit for a privatc or commercial rccrcotional dcvclopmefft, 23 (2) Certification process. 24 a. The notice of application shall include a copy 28 of the proposcd ordinance -or amendment, or a copy of thc proposcd inconsiste+it plat, or a 29 description of thc requested variance, or a copy of thc conditional use -permit application, 30 whcrc applicable. 31 b. The -cry shall notify thc commissioner of its final dccision on the proposcd action within te- 32 days of the decision. 33 •c. The action becomes effective whcn and only whcn cithcr: 34 1. The -final decision taken by thc city has previously received certification of approval from 35 thc commissioner; 36 2. The city received certification of approval aftcr its final decision; 37 3. Thirty days have -clapped from the day thc commissioner rcccivcd noticc of thc final 38 dccision, and the city has rcccivcd from the---eommissie-n-cr neither certification of 39 approval nor notice of non approval; or 40 4. The commissioner ccrtifics approval within 30 days aftcr conducting a publieh-caring: 41 d. In case the---eommissiancr gives noticc of non approval of an efdinancc, variance or 42 +eeonsiste-t plat, e+t cr thc applicant or the -administrator may; ithin 30 days of said noticc, 43 file with the-eommissioncr a dcmand for hcaring. If the dcmand for hcaring is not made within 44 30 days, the noticc of non approval becomes final. 45 1. The hcaring w+l-1 be held in an appropriate local community within 60 days of thc demand 46 and aftcr at 'cast two weeks published notice. 47 2. The hcarin uctcd in accordance with Minn.
